The ninth circuit court of appeals decided on this week that it would reexamine the legal dispute concerning the executive power with an larger panel of eleven justices. The court also overturned a earlier decision from a smaller judicial group that had supported the administration.

Legal Saga Over Troop Deployment

This order represents the most recent turn in a protracted court case over whether the administration has the authority and justification to send national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was initiated in response to months of protests.

Differing Viewpoints

The federal government has argued that government employees at the ICE facility in south Portland were facing threats, while city and state officials assert that municipal police have command of the situation.

In defiance of characterizations of the city as a conflict zone, locals have been posting videos of scenic paths and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland issued two legal injunctions this period – one blocking the federalization of the state troops, and another prohibiting the deployment of any national guard troops in Oregon, after efforts to evade the first order by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting control of state troops – but the second ruling stayed effective, blocking the actual deployment of the troops.

Full Panel Consideration

The latest ruling means the issue will be heard “en banc” – with all decisions under review simultaneously – by a group of 11 judges.

“This decision shows that the truth matters and that the courts are working to ensure government responsibility. The constitution restricts the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a official comment.

“The court is sending a definite signal: the president cannot send the military into American urban areas unnecessarily. We will continue protecting Oregon’s laws, principles, and autonomy as this legal proceeding progresses and our legal battle continues in the courts.”
